TERMS OF SERVICE

Dogman Cometh ("the App") is operated by Michael Patrick Fitzhugh, sole proprietor ("we," "us," "our"). By creating an account or using the App you agree to these Terms.

1. Entertainment Purpose Only

The App is provided for entertainment and community folklore purposes only. Nothing in the App constitutes a scientific claim, safety guidance, wildlife advisory, or law-enforcement service. Do not rely on any submission, verdict, map pin, or communication in the App as fact.

2. Eligibility

You must be at least 18 years old to use the App. By creating an account you represent that you meet this requirement and that all information you provide is accurate.

3. Your Account

You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at mikefitzhugh56@gmail.com if you suspect unauthorized use.

4. Submission Quotas (the 4·3·2·1 Rule)

Each account is capped, for the lifetime of the account, at: four (4) photos, three (3) text testimonies, two (2) audio clips (max 30 seconds each), and one (1) video clip (max 5 seconds). Slots are consumed the moment a submission is processed by our filter, whether or not the submission is ultimately transmitted. Slots do not reset, do not refill, and are not transferable.

5. Content Filter and Verdicts

All submissions pass through an automated content filter that assigns a verdict (green, amber, or red). We may reject, blur, redact, or refuse to transmit any submission at our sole discretion. A rejected submission still consumes the slot.

6. Location Data and Pings

The App records your approximate GPS location when you activate certain features. You consent to this collection. To control costs, additional pings from the same location are throttled server-side; only meaningful movement generates a new ping.

7. Your Content

You retain ownership of the media and text you submit. You grant us a worldwide, royalty-free, non-exclusive license to store, process, transmit, and display your submissions within the App and to community members. You represent that you have the right to submit the content and that it does not infringe or violate any third-party rights.

8. Prohibited Content

Do not submit content that depicts minors, sexual content, violence against people, self-harm, real threats, doxxing, hate speech, or unlawful activity. Do not submit content you did not capture yourself. Violations may result in immediate termination without refund.

9. Payment and Access

Access to the App may require a one-time or recurring payment processed by a third-party provider. All fees are quoted in U.S. dollars. Prices may change with notice for future billing cycles.

10. No Refunds After Filter Runs

See the Refund Policy. Because slots are consumed at the moment the filter runs, refunds are not available once any submission has been processed.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, misuse of the App, or activity that increases our operating costs beyond normal use.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

14. Governing Law

These Terms are governed by the laws of the State of Michael Patrick Fitzhugh's principal residence, without regard to conflicts of law. Disputes will be resolved in the state or federal courts located there.

15. Changes

We may update these Terms from time to time. Continued use after an update constitutes acceptance.
